State of health: EXCELLENT as puppy is parasite free with a Florida State Health Certificate. Is Puppy/ Dog required to be spayed/ neutered? Yes, unless otherwise noted and a fee of 500 is paid to the seller in addition to the purchased price of the puppy. TERMS AND CONDITIONS Buyer represents that they desire to acquire a Dachshund puppy for companion purposes only. Unless otherwise noted and agreed upon. NOW, THEREFORE, the parties agree as follows: 1. DOWN PAYMENT, PAYMENT OF PURCHASE PRICE, FEES Buyer WILL pay a down payment/ deposit of $500.00 non-refundable with payment of the balance of
$ __________________due prior to release of the Dog to Buyer. Payment of the balance must be made by cash at pick up of the said puppy unless other arrangements are made prior to the 8 weeks old health exam. Buyer acknowledges and agrees that Buyer will forfeit the deposit and any rights to the dog if: (a) Buyer fails to complete the purchase of the Dog for any reason Within 3 days past the Florida Heath Certificate Exam date. (b) Buyer fails to pay the balance of the Purchase Price within 3 days of Florida Health Certificate date. Puppy MUST be picked up from the seller within 3 days from the Heath Certificate exam date, unless agreements are made prior to 8 weeks old health exam for the puppy. Please NOTE: We do NOT hold puppies past 9 weeks old. All puppies must be paid in full and picked up within 3 days of their Florida Health Certificate or you forfeit the deposit placed on the puppy. Any other arrangements must be made before 8 weeks old if NOT picked up within the 3-day window of Florida Health Certificate. (c) Buyer fails to meet the Seller’s ethical requirements prior to the puppy being released. In either event, Seller shall be free to sell the dog to another party. In the event the dog is not available due to sickness, death, or any other circumstance owing to the fault of the Seller, Buyer’s down payment will be transferred to the next litter of puppies or refunded within 14 business days. Down payments/ deposits for puppies are non-refundable if the buyer changes their minds in buying the said puppy.

 

2. TRANSFER OF OWNERSHIP AND REGISTRATION: No registration paperwork will be provided until proof of spay/neuter from a licensed veterinarian is provided to the Seller. This is the buyers responsibly to provide the proof to the seller. Submission of paperwork and all fees associated with Permanent Registration shall be absorbed by the Buyer. Litters has been registered with CKC or AKC.

 
3. FITNESS OF PURPOSE - The Dog was bred as a companion animal only, and the Seller does not provide any warranty as to the Dog’s fitness for any specific purpose, including obedience trials, show ring performance, and/or breeding purposes. Furthermore, the Seller does not warranty or guarantee the adult size/ weight, conformation, coat quality including CDA that can run in dilutes (Blue or Isabella puppies), bite, weight, coat color, and markings and personality of the said puppy. We try our best to breed only healthy dilutes with healthy coats in our program. However, since dilutes are prone to CDA issues we are unable to warranty for CDA as there is no testing for this condition. CDA can appear at any given time in any generation as well as skip around in generations. We try to monitor our dilute lines for this condition.

 

4. SELLER’S REPRESENTATIONS, ACKNOWLEDGMENTS, AND WARRANTIES

 

Seller represents and warrants to Buyer that: (a) Gateway 2 Little Paws (Crystal Gates) the Seller is the legal and true owner of the puppy/ dog and that Seller has full right and authority to sell the puppy/ dog.

 

(b) The Dog is being sold free and clear of any lien, security interest, charge or other encumbrance.

 

(c) Seller guarantees that the Dog is a purebred dog, offspring of the purebred sire and purebred dam set out on this Agreement.

 

(d) Seller has taken the steps necessary to ensure that the puppy/dog is current on all vaccinations as per veterinary guidelines for age of Dog as stated in this Agreement.

 

(e) Seller guarantees Dog sold will have a 1-year health guarantee against Life Threatening Genetic Defects ONLY. Defects that will cause puppy to die or be euthanized before their first birthday. Documentation must be provided to the seller and documented by a licensed veterinarian. It is the responsibility of the buyer to give the seller these documents. Buyer is responsible for all cost of this. A diagnosis before one (1) year of age from a licensed Veterinarian and a Specialist that a Life-Threatening Genetic Defect exists and it will hinder the remaining quality of life. A Necropsy is required along with full access to all medical records. Guarantee is honored with a complimentary replacement puppy. This is done at buyers’ cost. Seller is not responsible for the cost of exams and any veterinarian testing or Necropsy. Seller must have said puppy up to date on all vaccinations required by law in order to guarantee a replacement puppy. All documents of proof must be given to the seller prior to replacement puppy. Price, Pick Order and Sex apply and are used to determine replacement puppy. Buyer will NOT get pick of the litter. Buyer will be given the option between two puppies to choose from of the same sex of the puppy that is being replaced, which they will pick one puppy as a replacement. 

NO REFUNDS WILL BE OFFERED 1. Breeder does NOT guarantee the behavior of any puppy. It is the responsibility of the Buyer to train and socialize their Dog.

2. Seller warrants that said puppy/ Dog has been properly socialized to the best of Seller’s ability.

3. Seller guarantees to be available for support, questions, advice, etc. for the life of the Dog.

4. Seller guarantees to welcome said puppy/ dog back at any time throughout its life for any reason. No refunds will NOT be given. Buyer must give the Seller the option to take the puppy/dog back first before it can be given to anyone else.

5. The Dog noted in this Agreement is being sold as a “PET ONLY” without breeding rights to the dog. Unless otherwise noted and “agreed upon”. Not every litter/ puppy will have the option for breeding rights. If breeding rights are given to the said puppy, a fee of 500 will be applied in addition to the purchased price of the puppy listed above.

6. Seller warrants that no registration paperwork will be given UNTIL proof of spay/neuter from a licensed veterinarian is provided. Paperwork must be provided within 10 business days of the spay / neuter. 

7. Seller warrants that if at any time the Buyer would like to terminate the “Pet Home” agreement, it is an option if the Seller agrees to let the said dog have breeding rights. This is NOT guaranteed. The Buyer must notify the Seller of their decision by the time the Dog is one year of age. Then at that time Buyer could purchase “Full Rights” to said dog if agreed on. The fee of 500 will apply to be given the breeding rights. CKC or AKC registration paperwork will NOT be sent to the buyer until the fee of 500 is paid to the Seller.

 

BUYERS RESPONSIBILITIES AND ACKNOWLEDGMENTS The Buyer must keep the dog indoors as to allow a healthy, comfortable, clean-living area separate from other animals until the Buyer can have the dog examined by a licensed veterinarian. Buyer agrees to have the puppy / dog exam done by a licensed veterinarian within 5 business days of the transferred date. The said puppy is being sold with a health certificate and is free and clear from parasites as it leaves the sellers possession to the seller knowledge. Seller is not responsible for any parasites after it leaves the seller possession. If the dog is found to have a life-threatening condition; upon proof of written documentation by a licensed veterinarian, the Buyer may return the puppy/ Dog to Seller for replacement – it is at the Sellers sole discretion as to if they want a replacement; however, it will be a litter mate to the Dog that was returned and same sex, if available – OR- a Dog from a future litter from Gateway 2 Little Paws. Failure to have a licensed veterinarian examination completed within 5 business days voids the Health Guarantee in this agreement.

 

Buyer agrees to be responsible in providing a healthy home environment for Dog, including but not limited to:

1. Proper, secured space

2. Plenty of exercise

3. Including proper socialization

4. Proper nourishment and healthcare

5. Proper licensing required by zoning according to place of residence and vaccinations required by laws.

Buyer agrees and acknowledges said Dog is NOT to be sold or rehomed at any time during said Dog’s life without prior permission from Seller. In the event the Buyer disregards this term/provision, the Seller has the right to confiscate said Dog back into their care or a fee of $500 will be paid to the Seller in violation to this agreement. Puppies are NOT fully protected from parasites, to include all worm’s species and heart worms, parvovirus and other illnesses. Seller is not responsible for parasites after the said puppy is transferred to the buyer. Buyer agrees to have the Dog spayed or neutered, at Buyer's sole expense between the age of 13 months to 2 years of age. If buyer Spays / Neuters the dog prior to 13 months of age buyers’ genetic health guarantee is voided. Failure to comply with this Section will void any and all of Buyer's rights. Written proof of the Spay/Neuter procedure from a licensed veterinarian must be provided to Gateway 2 Little Paws prior to receiving registration paperwork. Buyer agrees NOT to breed this dog for any purpose at any age. As recited above, the sale of the Dog pursuant to this Agreement is for companion purposes only and this is factored into the Purchase Price of the Dog. Additionally, improper use of the Dog for breeding purposes detrimentally impacts the purity of Gateway 2 Little Paws lines. Breeding rights are only given if the seller agrees to give the puppy the breeding rights, breeding rights are not guaranteed. If at any time the Buyer can no longer retain possession of this dog, the Seller is to be notified and given first option of resuming full ownership of dog. Seller has ten (10) days to accept or reject this right of the dog. Refunds are not given to the buyer for the puppy / dog. The dog will be returned with all CKC or AKC paperwork along with microchipping documents to be transferred back to the seller. All medical records must be returned to the seller. If the quality of life of the dog is in jeopardy, or buyer is using said dog in illegal activities the breeder/seller has the right to confiscate the dog at any given time. The Breeder/Seller reserves the right to approve/prohibit any transfer of this animal to a third party. Under no circumstances will this dog be sold, leased, traded, or given away to any pet shop, research laboratory, animal shelter or similar facility. Should the buyer be unable or unwilling to fulfill any of the above provisions, or if this dog is seized by any local authority as having been running at large, not Meeting County or city guidelines, neglected, abused, or abandoned, the seller retains the right to reclaim this dog without compensation. The buyer agrees to pay the seller any and all expenses, including court costs and reasonable attorney fees, in enforcing the terms and provisions of this contract. The buyer give permission for Seller to use any of their pictures of the purchased dog from all social media, texts, and e-mail messages for advertisement purposes. The Seller and Buyer have made no other agreements, promises, representations or warranties, express or implied, unless specifically stated in this Agreement.

ACCEPTANCE: The preceding paragraphs contain conditions established by the Seller to ensure the wellbeing of the puppy/dog. The undersigned buyer hereby acknowledges having read the terms of the contract and does hereby agree to abide by each of the provisions set forth above. All sales are final. If voluntary arrangements are made by the seller to repossess the dog due to the buyer’s inability to retain possession or for breach of contract, all costs accrued are the sole liability of the buyer.

Spay and Neuter Contract Agreement for Gateway 2 Little Paws

State of health: EXCELLENT as puppy is parasite free with a Florida State Health Certificate. Is Puppy/ Dog required to be spayed/ neutered? YES, puppy must be spayed or neutered unless noted otherwise. Buyer agrees to have the Dog spayed or neutered, at Buyer's sole expense between the age of 13 months to 2 years of age. If buyer Spays / Neuters the dog prior to 13 months of age buyers’ genetic health guarantee is voided. Failure to comply with this Section will void any and all of Buyer's rights. This Agreement grants Permanent ownership of this dog. It is contingent upon your compliance with this Addendum. Proof of the spay/neuter must be received by THE BREEDER within fourteen (14) days after the surgery. If the dog's health does not allow this agreement to be honored, Gateway 2 Little Paws/ the seller must be provided with a statement from your veterinarian that this dog is not yet in physical or emotional condition for surgery. Based upon the veterinarian's evaluation of this dog, the (purchaser) will contact the veterinarian and establish the earliest date that the procedure can be performed. (PURCHASER) will notify the BREEDER of this amendment in writing, at which time all other conditions of this agreement will apply and be enforced. This is the responsibility of the PURCHASER, not the veterinarian, to ensure that Gateway 2 Little Paws has received verification that the surgery has been performed. A copy of the medical record as well as the receipt is necessary for verification, along with the veterinarian’s phone number to follow up about the procedure. Failure to comply with this agreement by the date below, unless otherwise agreed to in writing, will be considered a breach of the Contract, and PURCHASER will transport this dog back to Gateway 2 Little Paws and will NOT be entitled to a refund. AKC or CKC registration paperwork will be released to the buyer after Gateway 2 Little Paws receives conformation that the said puppy / dog was spayed or neutered. PURCHASER will also be fined $500 in violation and the difference between the pet price and the breeding price of $500. The total price of $1000 must be paid to the seller for breach of contract and violation of the agreement/ contract within 60 days of the violation. 
In the case of the puppy's demise on or before the above-listed date, a written statement from your veterinarian must be sent to Gateway 2 Little Paws, stating that the puppy has indeed passed away and the cause of death. This is an unfortunate step but necessary. In a perfect world, we would like to have each puppy we place stay in their original purchasing home. Things do happen and should you need to transfer ownership before spay/neuter has been performed, you agree to contact Gateway 2 Little Paws, in writing, by phone at 989-305-5273, or by email at gates129@yahoo.com and let us know BEFORE the puppy has been placed into a new home. We require a right of first return or reclamation that the puppy be returned to us if you cannot keep him or her. No refunds will be given for the returned puppy / dog. You are not free to give the puppy away to another family member or anyone without receiving permission from us first. If you decide to go ahead and give the puppy to someone without contacting Gateway 2 Little Paws, this contract is still your responsibility. Should we not receive confirmation of the puppy's spaying or neutering by the above-listed age, as the original purchaser, you will then be liable for the dog’s full purchase breeding value of an extra $500 plus $500 in violation fees which is the sum of $1000 paid to the seller. By my signature below, I agree to have this dog spayed/neutered between the ages of 13 months to 2 years of age, and I understand that this spay/neuter agreement is an agreement that this dog will NOT produce a litter of puppies either as purposely bred or by accidental breeding. I also agree that should the puppy not be SPAYED/NEUTERED, I will return said puppy back to the seller/breeder with no refund.
